By downloading, accessing, or using the Servals iOS application (the "App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App. We may update these Terms from time to time, and your continued use of the App constitutes acceptance of those changes. Please review these Terms periodically.

2. Description of Service

Servals is an iOS client designed to interface with a user's self-hosted or locally accessible Ollama server (your "Ollama Instance"). The App facilitates sending prompts to and receiving responses from your Ollama Instance. The App itself does not provide large language model (LLM) services, host any LLM models, or store your conversation data on our servers.

3. User Responsibilities

You are solely responsible for:

  • Setting up, maintaining, and securing your Ollama Instance.
  • The LLM models you choose to run on your Ollama Instance and their compliance with any applicable licenses or terms.
  • The content of your prompts and the responses generated by your Ollama Instance through the App.
  • Ensuring that your use of the App and your Ollama Instance complies with all applicable local, state, national, and international laws and regulations.
  • Any data inputted into the App, which is processed locally and sent directly to your Ollama Instance.

4. No Registration and Data Privacy

Servals does not require user registration. We do not collect, store, or track any personal data or conversation history. All interactions are between the App on your device and your Ollama Instance. For more details, please refer to our Privacy Policy.

5. Intellectual Property

The App and its original content (excluding any content generated by your Ollama Instance), features, and functionality are and will remain the exclusive property of Servals and its licensors. The App is protected by copyright, trademark, and other laws of both the United States and foreign countries.

6. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

WE ARE NOT RESPONSIBLE FOR THE FUNCTIONALITY, ACCURACY, OR CONTENT OF ANY LLM MODELS ACCESSED THROUGH YOUR OLLAMA INSTANCE OR THE RESPONSES GENERATED THEREFROM.

7. Limitation of Liability

IN NO EVENT SHALL SERVALS, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY (INCLUDING YOUR OLLAMA INSTANCE) ON OR THROUGH THE APP; (III) ANY CONTENT OBTAINED FROM THE APP (PRIMARILY RESPONSES FROM YOUR OLLAMA INSTANCE); AND (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.
